The debate that never ceases: artificial intelligence and the new regulatory challenges

In recent years, artificial intelligence has ceased to be just a technical agenda to become a topic of public, legal and political interest. Technology, which transforms entire sectors with exponential speed, now requires society - and its leaders - to take a more conscious, critical and strategic stance. And not only in the field of innovation, but especially in the protection of rights, education, and governance.

During a recent event in Rio de Janeiro, the Supreme Federal Court minister, André Mendonça, emphasized that new technologies and artificial intelligence pose significant risks to society, but they also open up an unprecedented range of opportunities. The speech reinforces an essential point of attention: the impact of AI is not restricted to the private universe. It directly affects institutions, and the way in which we regulate the use and dissemination of information.


What is at stake with the advancement of AI

Artificial intelligence brings with it a new configuration of power. Technological platforms began to influence human decisions based on algorithmic models that learn with large volumes of data, often without proper supervision. The central issue is no longer just the development of AI, but rather who governs it, how it is trained, and for what purpose.

Governments, courts, and academic institutions today face the mission of balancing the benefits of this technology with the ethical and legal responsibilities it requires. It is in this context that Minister Mendonça's speech stands out: he draws attention to the urgent need to train teachers and professionals so that they know how to use digital tools with a critical sense and technical knowledge.

Digital education and public governance

There is no sustainable technological advance without a solid educational foundation. For artificial intelligence to become an instrument at the service of democracy and justice, it is essential to prepare educators and public managers to understand its functioning, its limitations and its potential. Digital literacy is no longer a complementary skill, it is a condition for contemporary citizenship.

And the challenge is systemic. Teachers, judges, civil servants, and public policy makers need to appropriate these tools not only as users, but as critical agents of transformation. Data governance, information security, algorithm traceability, and social impacts of AI need to be part of the public agenda with priority and transparency.

AI as an opportunity vector

Despite the risks, artificial intelligence can also be an ally in automation processes and data-based decision-making. When applied responsibly, it optimizes public services, combats fraud, and expands access to information. But that only happens when there are clear guidelines, effective regulation, and an institutional culture aimed at integrity.

As the minister rightly pointed out, the path is not to avoid AI, but to ensure that it is at the service of the common good. The challenge, therefore, is not only technical, but also ethical and regulatory.
